Grounds for Divorce in New York State

Until October 2010, New York was not a no-fault divorce state. This meant that you were required to prove a fault ground or you must have been legally separated from or lived separate and apart from your spouse pursuant to the terms of a written separation agreement for at least a year before a divorce could be granted. Now that the laws have changed, no-fault can be considered as a grounds for divorce or separation much sooner. Some of the grounds for divorce include:

  • Cruel and inhuman treatment.
  • Abandonment.
  • Constructive abandonment.
  • Confinement in a prison for a period of three years or more consecutive years.
  • The commission of an act of adultery (mere allegations or admission of cheating is not sufficient)
  • The husband and wife have lived separate and apart pursuant to a written agreement of separation for a period of one or more years.
  • The relationship between the husband and wife has broken down irretrievably for a period of at least six months.
  • No fault divorce.
