Grounds for Divorce in New York State

By law, New York is not a no-fault divorce state. This means that you are required to prove a fault ground or you must have been legally separated from or lived separate and apart from your spouse pursuant to the terms of a written separation agreement for at least a year before a no-fault divorce can be considered. Some of the fault grounds for divorce include:

  • Cruel and inhuman treatment
  • Abandonment
  • Constructive abandonment
  • Imprisonment for a period of three years or more
  • Corroborated proof of adultery (admission of cheating is not sufficient)

Contested and Uncontested Divorce in New York

Our firm helps clients in uncontested divorces when the husband and wife agree on all issues in the divorce, such as who gets what property (equitable property division), where the children will live (custody and visitation), and how much will be paid in alimony and child support (support and maintenance).

We also help clients in contested divorces in which the husband and wife cannot agree on one or more issues. Most couples do not agree on all issues from the get-go. We strongly encourage clients to try and resolve their disagreements through collaborative divorce or mediation. In the case of a contested divorce, our attorneys can draw on a wide variety of experts to assist us with divorce proceedings. These experts may include pension evaluators, tax experts, medical or psychological professionals, business valuation specialists, property appraisers, accountants, and private investigators.
