By law, New York is not a no-fault divorce state. This means that you are required to prove a fault ground or you must have been legally separated from or lived separate and apart from your spouse pursuant to the terms of a written separation agreement for a year or more before a no-fault divorce can be considered. Some of the fault grounds for divorce include cruel and inhuman treatment, abandonment, constructive abandonment, imprisonment for a period of three years or more, and corroborated proof of adultery, which means adultery alone or even by admission is not considered sufficient for this fault.
